[8] Miscellaneous - Petition of John Whitener complaining that petitioner was lawfully married to Molly Mull about 1803 and lived with her until Spring 1815. About that time, Molly became unfriendly to petitioner and was very friendly with Joseph Brown and Petitioner had been informed and believed that Brown has had unlawful connection with Molly. They were frequently together and very intimate, your petitioner was informe after said Molly departed from his hands and while petitioner was on a journey to Fayetteville with his waggon. Molly would leave her children and go with Brown to public places and beded together. Molly and petitioner had six children. Some time in the fall of 1815, while petitioner was from home, Molly went off and left all the children but one [Anthony] and has never returned. While she remained in the neighborhood, Brown and Molly had frequent meetings in private and have gone off together traveling to the State of Tennessee.
Petitioner stated he was left with five small children to take care of without the assistance of any woman. Requests divorce be granted. John Whitener swore that he had given this information six months before this date.
Subpoena issued 1 May 1816 to Molly (Mull) Whitener, wife of John D. Whitener to appear at Superior Court 4th Monday after 4th Monday September to answer John Whitener's petition.
2nd subpeona issued September 1816 to Molly (Mull) Whitener to appear and answer the charges.

This Bastardy Bond was not recorded in Court minutes as John and Margaret handled it themselves. This was an unusual document for the woman had signed the Bond. Normal procedure was for a relative of the man or woman to co-sign. This child was believed to have died after 1830.

[19, 20, 21] - I have long suspected something like this regarding John Whitener and Margaret Dellinger, because they have children with birthdates that overlap the birthdates of his children with Polly Miller. I would like to find documentary evidence of this court case:
"John W. Whitener or John D. Whitener, as his name often appears, must have been quite a charmer and most appealing to the ladies! I am very fond of him, but when Clara Shook was at the Archives and found the case where John Whitener was brought up for charges of adultery with Margaret Dellinger, I wanted to cheer. I noticed Caleb Miller, Polly's brother, was at Court that day and would bet he made the charge against John Whitener."
